Live Time Inc. (“Live Time”, “we”, “our” or “us”) takes the privacy and protection of personal information seriously. By visiting our website or accessing or using our services, including the Live Time App, you acknowledge and accept the practices and policies outlined in this Privacy Policy (the “Privacy Policy”). This Privacy Policy applies to all information collected from or about you by Live Time. The purpose of this document is to help you understand what information is collected from or about you, how this information is used and protected, and what options you have with regard to this information.
II. Information Covered by This Policy
For purposes of this Privacy Policy, our use of the term “Information” means any and all information we receive from or about you. This may include (without limitation) information collected from you directly or indirectly, manually or otherwise, or via electronic, automatic or other means, including (without limitation) via stationary, mobile, or any other devices. Such information may include information (i) which you provide during the course of your use of our website (the “Site”), or your use of our services, including the Live Time App, (the “Services,” together with the Site, our “Platform”); (ii) collected about you, your business, and the technology you are using, and (iii) which we receive about you from third parties or other sources.
Information is divided into two distinct categories:
- “Non-Personal Information” means Information which does not personally identify a person.
- “Personal Information” means Information related to a natural person that can be used to directly or indirectly identify the person, such as names, addresses, e-mail addresses, and phone numbers, as well as other non-public information that is associated with the foregoing.
Our Site and the Services we provide are not intended for use by children under the age of 13. We do not knowingly accept as users or collect Personal Information from or about children under the age of 13.
III. Acceptance of Terms
We obtain and use Information in accordance with this Privacy Policy. We will ask for your consent before using Personal Information in a manner other than as set out in this Privacy Policy.
By accessing or using our Services or visiting our Site or submitting information through the Services or via our Site, you expressly consent to the collection, processing, and use of your Information in accordance with this Privacy Policy, including the collection, use, disclosure, storage, transfer, and processing of your Information, including your Personal Information, as described herein. Your Information, including your Personal Information, may be processed in the country where it was collected as well as in other countries where laws regarding the processing of information, including personal information, may be less stringent than the laws in your country.
If you do not agree with our Privacy Policy, please do not use our Site or Services.
IV. How We Obtain and Collect Your Personal Information
You may provide us with your Personal Information voluntarily. However, we may also receive Personal Information about you from third parties such as marketing agencies, market research companies, our suppliers, contractors, and consultants, your contacts (including colleagues, acquaintances, and social and business contacts), websites accessible to your contacts, public websites, and public agencies.
We collect Personal Information (i) that you give us by filling in forms, using our Services, contacting us, setting up an account with us, or by contacting us by phone, email, or other means; and (ii) that we learn about you from our interactions, communications, and dealings with you and with other users of our Services.
We may also collect Personal Information you communicate to other users of the Services or the Site through the Services or the Site. However, we are under no obligation to review, and assume no responsibility or liability relating to, such communications.
In addition, we will track your usage of our Site and the Services, including how you interact with our Site and the Services. We also collect Personal Information automatically when we receive and store certain types of Information automatically when you interact with the Site or use the Services.
V. Information We Collect
We collect the following Personal Information:
Information We Collect
Personal Information about You: When you visit our Site, download the Live Time App, or become a user of our Services, we may collect Personal Information about you, including the following types of information: your name; gender; date of birth; government-issued identification and/or number; photo identification; profile photograph or video; address; email address; telephone number; country and state of residence; nationality; place of birth; country of birth; information about and related to your social and business affiliations (such as the name of your educational institutions, fraternal organizations or employment); information about your marketing preferences; and general information about your interests, including your interest in our products and services. We may sometimes ask you to provide proof of identity or age in order to use certain features of the Services, to ensure that you are old enough to use the Services, or in other instances where verification may be required.
Your Contacts Directories: You must have permission before sharing Information about other individuals with us. If you choose to sync your phone or other contacts directories, we will access and collect Information such as names, phone numbers, and email addresses, and match that information against existing users of the Services. If you choose to share your social network contacts, we will collect your public profile information as well as names and profiles of your social network contacts.
Your Content:We process the content you generate using our Services, including photographs, audios, and videos you upload or create, comments, hashtags, feedback, reviews, and livestreams you make, and the associated metadata, such as when, where, and by whom the content was created (“User Content”). If your User Content includes Information about other individuals, you must obtain their permission before sharing such Information with us. We may collect User Content to provide personalized recommendations about how to use our Services.
Your Device’s Clipboard:We may access content, including text, images, and video, found in your device’s clipboard, with your permission. For example, if you choose to initiate content sharing with a third-party platform, or choose to paste content from the clipboard into the Services, we access this information stored in your clipboard in order to fulfill your request.
Messages.We collect Information you provide when you compose, send, or receive messages through the Platform’s messaging functionalities. That information includes the content of the message and information about the message, such as when it was sent, received, or read, and message participants. Your communications with other users of the Services or the Site may be monitored, recorded and/or reviewed by Live Time. Please be aware that messages you choose to send to other users of our Services or to third-party platforms accessible through the Services will be accessible by those users and third parties. Live Time is not responsible for the manner in which those users and third parties use or share the messages.
Correspondence. Whenever you contact us or respond to our communications (e.g., in email, telephone, or writing), we receive your contact information and any other Personal Information you choose to provide us. We will use such Information to fulfil your requests or to provide the Services. We collect Personal Information when you use or request information about our Services, subscribe to marketing communications, request support, complete surveys, or sign up for and/or attend events we participate in.
RSVP and Purchase Information. If you make a reservation (even if the event or item is free), a purchase or a payment on or through the Platform, we may collect Information about that transaction. Such Information may include payment card information, billing, delivery, and contact information, and Information about the event or item, including whether you attended an event.
Automatically Collected Information
In addition, the following Information is created and recorded automatically when you visit our Site or use our Services:
Usage Information:We collect Information regarding your use of the Site and the Services, including traffic data, location data, weblogs, and other communication data and information provided when requesting further service or downloads. This Information may include data describing how you interact with content or advertising presented on the Site and the Platform or problems encountered in using the Site and the Services, browsing and search history, the content you like or “bookmark,” and how you engage with other users of the Site or the Services, or third-party providers.
Session Recording and Replay:We use a third-party analytics provider to record and replay sessions on the Site and in the Live Time App. A recording reconstructs the pages you were shown and how you interacted with them, including your clicks, taps, scrolling, and navigation. We configure this recording to mask Personal Information before it leaves your device: the contents of form fields are not recorded, apart from a small number of fields we have specifically marked as recordable (such as an event’s title and description), and Personal Information displayed on the page — including guest names, guest lists, contact details, and profile names and schools — is replaced with placeholder characters. We do not record your sign-in identifier or the one-time code sent to you. We use session recordings to diagnose problems with, and to improve, the Site and the Services.
Technical Information From Your Devices and Networks: We may collect Information about the devices and networks you use to access the Site and the Services, and how you use them, such as: (i) your IP address, user agent, mobile carrier, time zone settings, identifiers for advertising purposes, model of your device, the device system, network type and device IDs, and (ii) your screen resolution and operating system, app and file names and types, keystroke patterns or rhythms, battery state, audio settings and connected audio devices. If you log-in from multiple devices, we may use your profile information to identify your activity across devices. We may also associate you with information collected from devices other than those you use to log-in to the Services.
Location Information:We may collect Information about your approximate location, including location information based on your SIM card and/or IP address. With your permission, we may also collect precise location data (such as GPS). We collect Information about and related to venues and landmarks when you include such Information in your User Content. Location information collected through your use of Google Maps is addressed in the “Google Maps” sub-section in Section VII below.
Image and Audio Information: We may collect Information about the videos, images and audio that are a part of your User Content. In doing so, we may categorize and analyze visual Information (including faces, body parts, settings and backgrounds) and audio Information (including spoken words) in User Content. We may collect text, image, audio and other Information from User Content for content moderation, for demographic classification, for content and ad recommendations, to enable various special effects, and for non-personally identifying purposes.
Information From Other Sources
We may also receive Information about you from other sources:
Social Networks: Third-party social network (e.g., Instagram, LinkedIn, TikTok, Facebook) accounts, or login services, if you choose to register or use the Services using such third party services. These third parties may provide us with your username, public profile, and other Information, which may include information about your use of that third party service. When we receive such Information, it is with the understanding that you have permitted us to receive it, but we do not verify that such permission was granted by you. With your permission, we will share Information with your social network.
Other Users and Other Individuals: Your Information may be included in User Content, or messages. We may also obtain Information about you when we receive a complaint, appeal, request, or feedback, or if your contact information is provided to us.
Business Partners: Advertising, traffic measurement, and other business partners may share with us Information about your activities outside of the Site or the Services, such as on other websites and apps or in stores, including purchases you made, online or in person. Information provided to us by these business partners may include mobile identifiers for advertising, hashed email addresses and phone numbers, and cookie identifiers. Please see the section titled Cookies, below, for more information related to how these business partners may provide Information about you to us.
Ticket Sellers, Merchants, and Payment Services: We may receive Information about your transactions, including confirmations and payment details.
Sources of Publicly Available Data: We may collect Information about you from publicly available sources.
VI. Cookies
We, and the third parties we may partner with, may store and retrieve information on and from your browser by placing a small text file called a “Cookie” in the browser files of your computer, smartphone, or other device. By using the Services or the Site, you agree that we may use, store, and access Cookies on and from your computer, smartphone, or other device. VII. Google Calendar and Google Maps
Google Calendar
If you choose to connect your Google Calendar to the Services, Live Time requests read-only access to your Google Calendar using the following Google OAuth scopes: https://www.googleapis.com/auth/calendar.events.readonly and https://www.googleapis.com/auth/calendar.freebusy. With your authorization, we:
- read your free/busy availability; and
- read your calendar events, including event times, titles, and attendees
(together, your “Google Calendar Data”).
Use.We use this access solely to provide user-facing features within the Services — including identifying mutual availability among users, suggesting event and meeting times, and displaying and organizing your events within the Services. We do not create, modify, or delete entries on your calendar, and we do not read your Google Calendar Data for any other purpose.
Human access. No employee, contractor, or agent will read your Google Calendar Data, except: (a) with your affirmative agreement to view specific data, such as when you request support; (b) where necessary for security purposes, such as investigating a bug or abuse; (c) where necessary to comply with applicable law; or (d) where the data has been aggregated and anonymized and is used for internal operations.
Change of control. We will not transfer Google Calendar Data as part of a merger, acquisition, or sale of assets without first obtaining your explicit prior consent.
Revoking access and deletion. You may disconnect your Google Calendar at any time. Upon disconnection or deletion of your account, we stop accessing your calendar, delete stored Google Calendar Data, and revoke associated access and refresh tokens.
Limited Use. Live Time’s use and transfer of information received from Google APIs to any other app will adhere to the Google API Services User Data Policy, including the Limited Use requirements.
Google Maps
The Services use Google Maps Platform APIs, including the Places API, to provide venue search, address autocomplete, and location features. By using these features you are also using Google Maps, and Google’s collection and use of data through those services is governed by the Google Privacy Policy, which is incorporated into this Privacy Policy by reference, and by the Google Maps/Google Earth Additional Terms of Service.
Data Google receives.When you use these features, Google collects and receives data directly from you and your device, including your search terms, your IP address, and latitude and longitude coordinates, and may use and retain that data to provide and improve Google’s products and services. We do not transmit your name, email address, telephone number, or other information identifying you to Google through these services.
Location data and combination with other sources.With your express, prior consent, we collect location data from your device — including approximate location and, where you permit it, precise (GPS) location — to show nearby venues, suggest event locations, record your RSVP and whether you attended an event, and determine service and delivery availability. We combine your location with data from other providers, including place and venue data from Google Maps Platform and service-area data from our fulfillment partners (e.g., Gopuff), in order to provide these features. We do not obtain or cache your location without your consent, and you may withdraw consent at any time through your device settings.
VIII. Non-Personal Information
Non-Personal Information may be collected, processed, and used in accordance with applicable law, for any and all purposes we deem fit. Generally, the Information Live Time collects is used for our own internal purposes, for example, to improve the Services and the Site, to improve our marketing and promotional efforts, to improve customer service, and to improve Live Time content and Site offerings, and may also be used by Live Time to contact you to provide you with information which we believe may be useful to you. Live Time believes that these uses allow us to improve the Services and our Site and to better tailor them to meet your needs.
IX. Use of Personal Information
In general, Personal Information you submit to us, or that is obtained by us, is or may be used:
- to create and manage the relationship between us;
- to provide and support our Services, including event planning, invitations, communication with other users, and user support;
- to understand how you use the Services, including across your devices, and to ensure content is presented in the most effective manner for you and your device;
- to infer additional information about you, such as your interests;
- to, subject to your permission, provide you with location-based services;
- to curate Services content (including advertising and marketing) for you based on your settings, contacts, interests, or location;
- to support the social functions of the Services, which may include permitting you and others to connect, sharing your activity status, providing messaging, and making suggestions for interaction with other users of the Services and User Content;
- to promote events, topics, hashtags, and campaigns on the Services;
- to facilitate and communicate with you about events, including serving invitations, soliciting and recording responses, and recording attendance, which may include collecting and reporting precise location data when you use location-based features of the Services;
- to offer you the possibility of purchasing event tickets, subject to additional ticketing terms and conditions, including by partnering with third party providers who offer ticketing services, with which we may, subject to your permission, share Personal Information about you (such as your device ID and location);
- to improve our technology, which may include training machine learning models and improving algorithms;
- to, subject to your permission, facilitate research conducted by independent researchers;
- to communicate with you about our Services;
- to send you notifications regarding your use of the Services or the Site;
- to send you notifications by various means, including regular mail, email, telephone, including voicemail, or SMS (text message);
- to respond to requests that you make;
- to bill you when appropriate and to resolve fee disputes and for other associated billing services;
- to further new services or products;
- to operate, maintain, and improve the features, functionality, and performance of our Site and Services;
- to comply with our legal obligations;
- to comply with our regulatory obligations;
- to monitor compliance with our rules and contractual terms of use;
- to enhance security, prevent fraud or abuse or other harmful or illegal activity, monitor and verify identity or service access, combat spam or other malware or security risks, including by scanning, analyzing, and reviewing User Content, messages and associated metadata for violations of laws and regulations and our conditions and policies;
- to deliver targeted advertising and marketing (which may include User Content) and service update notices;
- to measure and understand the effectiveness of targeted advertisements and other content we serve on the Platform;
- to enforce our agreements with third parties; and
- to protect our business and to enforce and exercise our rights.
Furthermore, we may create anonymized information from Personal Information by excluding information that makes the Information personally identifiable to you. We may use this anonymized information for internal purposes, such as analyzing usage patterns, so that we may enhance the Site and Services, and we also reserve the right to use and disclose such anonymized information at our discretion to third parties. Such anonymized information may be deemed to be Non-Personal Information and used accordingly.
X. Disclosure of Personal Information
Except as otherwise stated in this Privacy Policy, we will not disclose or share your Personal Information with third parties, unless you ask or authorize us to do so.
Pursuant to this Privacy Policy, we may disclose or share your Personal Information as follows:
Disclosure to Service Providers and Affiliates
We provide your Personal Information to third party service providers and suppliers who work on our behalf or with us (a) to provide you with some of the services and features of the Services, (b) to operate, improve, understand, customize, and support the Services or the Site, (c) to help us communicate with our users, (d) to assist us in our marketing, advertising and promotional activities (e) to provide analytics and search engine services that assist us in the improvement and optimization of our Services or our Site, (f) to help us with our business and informational needs, and (g) to provide ticketing or payment services or other transaction fulfillment functions to or through the Services, and (h) to help us communicate with our users, (“Service Providers”). Our Service Providers, however, do not have any independent right to use your Personal Information for their own purposes not connected to Live Time. We will always attempt to limit the information we provide to what is reasonably sufficient for our Service Partners to carry out their responsibilities to Live Time.
We may share some or all of your Personal Information with any parent company, subsidiary, joint venture, or other company under common control (collectively, “Affiliates”), in which case we will require our Affiliates to honor this Privacy Policy.
Disclosure to Partners
We may share your name, browsing behavior, IP address, and other information we collect about you with our partners, sponsors, and advertisers (“Partners”). See our list of Partners at https://www.liveti.me/brands. By sharing your information with us, you agree that (a) Live Time may share your name, email address, phone number, educational institution, and IP address with our Partners, and (b) Live Time and its Partners may contact you by way of messaging, email, telephone, mail, or other means of communication to provide you with access to content, surveys, direct marketing, and promotional materials in connection with your activity on the Site and via the Services. If you do not want this information shared, you may opt out of our sharing this information with our Partners by contacting us at the email address set forth below in the section entitled “Contact Us and Opting Out.” In addition, you may contact a Partner directly if you have any questions about such Partner’s use of your information or if you would like to cease receiving communications from a specific Partner.
Change of Control
In the event Live Time goes through a business transition such as a merger, acquisition by another company, or sale of all or a portion of its assets, your Personal Information will likely be among the assets transferred. You acknowledge that such transfers may occur, and that any acquirer of Live Time or its assets may continue to use your Personal Information as set forth in this Privacy Policy.
Compliance with Law and Enforcement of Rights
We may (and you authorize us to) disclose information we have collected from and about you (including Personal Information) if we believe in good faith that such disclosure is necessary to (a) to comply with relevant law, (b) to respond to court orders, subpoenas or warrants served on us; (c) to enforce our Terms of Use and this Privacy Policy; or (d) to protect and defend our rights or property, or the rights and property of the users of our Services or third parties.
Third Party Sites
Our Site and Services may include social media features such as the “Share This” button for Twitter and Facebook. These features may set a Cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our Site. Your interactions with each of these features are governed by the privacy policy of the company providing the feature.
Third parties with whom you interact, including your educational institutions, fraternal organizations, or employers, the social networks on which you maintain a presence, and other third parties that have access to your Personal Information, may have their own privacy policies, and Live Time is not responsible for their operations, including, but not limited to, their personal information practices. Personal Information collected by such third parties, which may include contact details, is governed by their privacy practices. We encourage you to learn about the privacy practices of those third parties.
XI. Retention of Your Personal Information
We keep your Personal Information for as long as is necessary for the purposes for which the Personal Information is processed. The length of time for which we retain Personal Information depends on the purposes for which we collect and use it and/or as required to comply with applicable laws and to establish, exercise or defend our legal rights.
XII. Data Transfers
We may transfer the Information, including Personal Information, we collect about you to recipients in countries other than the country in which the information originally was collected, including but not exclusively, countries outside the European Economic Area (“EEA”). Those countries may not have the same data protection laws as the country in which you initially provided the Information. By using or participating in any of our Services or the Site, and/or by providing us with your Information, you consent to the collection, transfer, storage, and processing of your Information in such other countries, including countries outside of the EEA. In those cases where we transfer Personal Information collected in the EEA to Affiliates or to our service providers located in countries outside the EEA, we will take appropriate measures to ensure that the recipient protects your Personal Information adequately in accordance with this Privacy Policy. These measures may include entering into European Commission approved standard contractual arrangements designed to ensure that your Personal Information is protected.
XIII. Legal Bases for Our Use of Your Personal Information
We rely on both your consent and our legitimate business interests as the legal bases for processing Personal Information.
In this regard, we use your Personal Information when necessary (a) to perform our obligations under any contract with you; (b) to comply with our legal obligations (for example, complying with our legal and regulatory obligations); and (c) for our legitimate interests or the legitimate interests of others (for example, to ensure the security of our Site or Services). If we rely on our (or another person’s) legitimate interests for using your Personal Information, we will undertake a balancing test to ensure that our (or the other person’s) legitimate interests are not outweighed by your interests or fundamental rights and freedoms which require protection of the Personal Information.
If we rely on your consent for us to use your Personal Information in a particular way, but you later change your mind, you may withdraw your consent by contacting us at the e-mail address set forth in the “Contact Us” section below, and we will stop doing so.
XIV. Links to Other Websites
The Services and/or the Site may contain links to other websites that are not owned or controlled by us. The provision of such links does not signify our endorsement of such websites or their content. We have no control over, do not review and are not responsible for, the privacy policies, terms of use, or content displayed on such other websites. Please check the policies of these other websites before you submit any information to them. Please be aware that the terms of our Privacy Policy do not apply to any outside websites.
XV. Security and Confidentiality
Live Time has put in place commercially reasonable protections and procedures to safeguard and secure the Personal Information we collect. However, even with these measures, we cannot guarantee the security of Personal Information. By using our Services or our Site, you acknowledge and agree that we make no such guaranty. The transmission of Information to or via our Services is at your own risk.
XVI. Access to, Correcting, or Deleting Your Personal Information
If we hold Personal Information about you, you may request that we correct, amend, or delete certain information where it is inaccurate, within reason and in accordance with applicable laws. Prior to fulfilling any request for information or deletion, we may require you to provide information so that we may verify your identity. Subject to applicable laws, we reserve the right to decline requests that are unreasonable, present risk to the privacy of another individual, may jeopardize the confidentiality of another party, are excessively repetitive, or may require significant technical modifications to our systems. XVII. Your Rights with Respect to Your Personal Information
EU data protection law makes a distinction between organizations that process personal information for their own purposes (known as “Data Controllers”) and organizations that process personal information on behalf of other organizations (known as “Data Processors”).
In the limited circumstances where we act as a Data Controller, EU citizens have certain data protection rights, including:
- the right to access your Personal Information;
- the right to restrict the use of your Personal Information;
- the right to have incomplete or inaccurate data corrected;
- the right to ask us to stop processing your Personal Information;
- the right to require us to delete your Personal Information in some limited circumstances; and
- the right in some circumstances to request for us to “port” your personal data in a portable, re-usable format to other organizations (where this is possible).
We will consider all such requests and provide our response within a reasonable period (and in any event within one month of your request unless we tell you we are entitled to a longer period allowed by applicable law). Please note, however, that certain Personal Information may be exempt from such requests in certain circumstances, for example if we need to keep using the information to comply with our own legal obligations or to establish, exercise or defend legal claims. If an exception applies, we will tell you this when responding to your request. We may request you provide us with information necessary to confirm your identity before responding to any request you make.
XVIII. Marketing Activities
We may collect and use your Personal Information for undertaking marketing by messaging, email, telephone, and mail. We may send you certain marketing communications (including electronic marketing communications to existing users) if it is in our legitimate interests to do so for marketing and business development purposes.
We will always obtain your consent to direct marketing communications where we are required to do so by law (for example, if you have provided a personal email address to us) and if we intend to disclose your personal information to any third party for such marketing. XIX. Changes to This Privacy Policy
We may change this Privacy Policy at any time by posting a new version on this page or on a successor page. The new version will become effective on the date it is posted. We reserve the right to modify this Privacy Policy at any time, and you agree that your continued use of our Services or our Site shall constitute your acceptance of any modifications to such Privacy Policy, so please review it frequently.
